難民定義：
外國人或無國籍人，因 政治迫害、基本人權侵害而不受該國法律習俗保護、因宗教信仰受到逼迫、種族對立、鄰近國家拒絕 等，在原國籍國或原居住國之外，有充分正當理由恐懼受迫害，致不能或不願受該國之保護或因該恐懼而不願返回該國者，得向我國申請難民認定。

審核、判定是否能夠接納難民的前提
- 國內是否有基礎社會、軟硬體建設，給予難民人道對待？
- 如何營造一個能夠接納不同意見人的安全空間，而非以難民營、精神療養院所、監獄、或其他限制人身自由之機構收容這些難民？
- 國家是否能研發一套難民與移民融入台灣社會、經濟與文化生活的具體配套措施？

辯論點：
- 條件寬（除了中國），依目前國際局勢來看，台灣與中國還是同一個國家，難民法來看，需不同國籍
- 明確定義（法律）很重要保護權利，但部分成員覺得不見得—> 民意是否作為考量（台灣多數以法律作為主要結果）
目前台灣現況（鈞媛）：
- 無法律相關規定無法依法行政，再者因為少有立委推動，而停滯。
- 多數人對於難民的未知與無感，為何需要投入資源？
- -> 情感上難接受1950年代國共內戰後來台的移民（但犯戰爭罪就不算是難民）

外國人或無國籍人，因種族、族群、宗教、國籍、政治見解、醫療與疫病條件、自然或人為災害、性別認同與性傾向、特定社會團體的成員身份等任一類別原因，在原國籍國或原居住國之外，有充分正當理由恐懼受迫害，致不能或不願受該國之保護，或因該恐懼而不願返回該國者，得向我國申請難民認定。
(備註你們認為政府應如何審核及判定這些原因)
備註：（就模糊空間作延伸敘述）
- 政府審核及判定之單位：移民署。
- 不需由尋求庇護者本人申請，可透過尋求庇護者之親屬、該國或國際人權組織（包括但不限於NGO, NPO…etc）進行申請程序。
- 若迫害類別具有多元交織性(intersectionality)，則符合定義中的任一類別即可申請。
- 所謂正當理由恐懼，除了尋求庇護者過去親身經驗外，包括但不限於該國已有定義中任一類別迫害之個案，致使尋求庇護者感到恐懼者。

GROUP 1
Refugee definition:
Foreigners or stateless persons who are not protected by the laws and customs of the country due to political persecution, violation of basic human rights, persecution due to religious beliefs, racial antagonism, rejection by neighboring countries, etc., and who have well-founded fears of persecution outside their country of origin or country of residence and are unable or unwilling to be protected by that country or unwilling to return to that country due to such fear, may apply to our country for refugee recognition.
(Note how you think the government should review and determine these reasons)

- Thoughts on Taiwan becoming a neutral country –> Hosting country (discrimination?)
- If it comes to Taiwan due to other factors, –> Possibility of transferring to other countries
- Consider how many people can be sheltered
GROUP 2
Refugee definition:
Foreigners or stateless persons who, due to war, persecution (based on religion, race, gender identity or sexual orientation, political stance, social group affiliation), etc., have well-founded fears of persecution outside their country of origin or country of residence and are unable or unwilling to receive protection from that country or are unwilling to return to that country due to such fear, may apply to our country for refugee recognition.
(Note how you think the government should review and determine these reasons)
SOP：
- Is there basic social, software and hardware construction in the country to treat refugees humanely?
- How to create a safe space that can accommodate people with different views, instead of housing these refugees in refugee camps, mental health facilities, prisons, or other institutions that restrict personal freedom?
- Can the country develop a set of specific supporting measures for refugees and immigrants to integrate into Taiwan’s social, economic and cultural life?

Debate point:
- The conditions are wide (except for China). According to the current international situation, Taiwan and China are still the same country. According to the refugee law, different nationalities are required.
- A clear definition (law) is important to protect rights, but some members think it is not necessary —> Whether public opinion should be considered (most in Taiwan use law as the main result)
The current situation in Taiwan (Jun Yuan):
- Without relevant legal provisions, administration cannot be carried out in accordance with the law, and furthermore, it has stalled because there are few legislators to promote it.
- Most people are unknown and indifferent to refugees, so why do we need to invest resources?
- -> It is emotionally difficult to accept the immigrants who came to Taiwan after the civil war between the Kuomintang and the Communist Party in the 1950s (but those who committed war crimes are not considered refugees)
GROUP 3
Refugee definition:
Foreigners or stateless persons who, due to any type of reasons such as race, ethnicity, religion, nationality, political opinions, medical and epidemic conditions, natural or man-made disasters, gender identity and sexual orientation, membership of a specific social group, etc., have well-founded fears of persecution outside their country of origin or residence, and are unable or unwilling to receive protection from that country, or who are unwilling to return to that country due to such fear, may apply to our country for refugee recognition.

Remarks: (Extended description of fuzzy space)
- The government review and determination unit: Immigration Department.
- It is not necessary for the asylum seeker to apply himself. The application process can be carried out through relatives of the asylum seeker, the country or international human rights organizations (including but not limited to NGOs, NPO…etc).
- If the persecution category has intersectionality, you can apply if you meet any category in the definition.
- The so-called legitimate fear includes, in addition to the past personal experience of the asylum seeker, cases of any type of persecution defined in the country that cause the asylum seeker to feel fear.

- Ethnic group–>Broad term, can include multiple contexts; Gender–>Must be clearly listed
- The application procedure for filling out the application –> needs to be interviewed and explained in person. For example, the translator needs to be of the same gender, etc. This will be written in the work rules.
